The High Court found that the trial magistrate erred in adopting a multiplicand of Kshs. 30,000/- without sufficient proof of the deceased's earnings and that the multiplier of 11 years was excessive given the deceased's age and occupation. The court held that, in the absence of documentary evidence, the minimum wage for a semi-skilled worker (tailor) under the Regulation of Wages (General) (Amendment) Order 2018, being Kshs. 18,881.21, was appropriate. Considering the deceased's age (54) and the nature of his work, the court determined a multiplier of 8 years was reasonable.
