The High Court found that the trial magistrate erred in reducing the dependency ratio to 1/3 solely because one of the deceased's children died in the same accident. The evidence showed that the deceased supported both her spouse and surviving child, but also that financial responsibility was shared. Therefore, a dependency ratio of 1/2 was appropriate. On the multiplicand, the trial magistrate wrongly deducted all amounts from the deceased's salary, including non-statutory deductions. The correct approach is to deduct only statutory deductions (PAYE and NHIF) from the gross salary to arrive at the net income for the multiplicand.
