The High Court held that the sentence of 40 years' imprisonment imposed on the appellant for defilement was unlawful because Section 8(2) of the Sexual Offences Act prescribes a mandatory sentence of life imprisonment for defilement of a child aged eleven years or less. The court relied on the Supreme Court's recent decision in Republic v Joshua Gichuki Mwangi, which clarified that sentencing courts lack discretion to impose any sentence other than life imprisonment in such cases. The appellate court found no basis to interfere with the sentence and, instead, enhanced the sentence from 40 years to life imprisonment, setting aside the previous sentence as contrary to law.
