The Respondent's explanation that the court file was missing was unsupported by evidence, and he did not attempt to obtain pleadings from the Claimant's advocate. The draft defence did not deny the loan or arrears and failed to raise any triable issue. The Tribunal held that no plausible reason was provided for the failure to file a defence and that the draft response did not merit setting aside the regular default judgment.
