The Tribunal found that as at the date of the application and service of the Decree Nisi, the Garnishee held funds (Kshs.819,202) on behalf of the Judgment Debtor. The Decree Nisi, once served, operated as an injunction, binding the Garnishee from releasing the funds. The Garnishee's explanation for failing to stop payment was found unconvincing, as reasonable steps such as electronic communication could have been taken to halt the cheque. The Tribunal concluded that the Garnishee was still liable for the sum of Kshs.340,000, being the difference between the total attached and the amount already released, and issued a decree absolute for this amount.
