The court found that the plaintiff entered into a valid sale agreement for one acre of land in 2000, paid the full consideration by 8 May 2001, and took vacant possession in March 2001. Although the parties failed to obtain Land Control Board consent within the statutory period, the plaintiff remained in possession, and the contract became void for want of consent. From that point, the plaintiff's possession was no longer permissive but adverse to the registered owner. The court held that there was no credible evidence of eviction, repudiation, or interruption of possession between 2001 and 2013, and thus, by operation of Section 38 of the Limitation of Actions Act, the plaintiff's rights...
