Ratio Decidendi

The court found that the applicants, having chosen to pursue a review of the court's decision delivered on 10th March, 2022, and having had that review application determined, could not subsequently seek leave to appeal the same decision. This is expressly prohibited by Order 45 Rule 2 of the Civil Procedure Rules and supported by case law, which holds that a party must elect one remedy—either review or appeal—but not both in respect of the same order or decree. The court held that the applicants' attempt to pursue both remedies amounted to an abuse of the court process. Consequently, the application for leave to appeal out of time was unmerited and was dismissed with costs.
