The High Court found that the trial magistrate failed to adequately consider the mitigating factors of partial recovery and restitution of the stolen property and the applicant's admission of the offence. Exercising its revisionary jurisdiction, the court determined that these factors warranted a review of the custodial sentence. The court substituted the remaining custodial sentence with a non-custodial Community Service Order, to be served at Esibakha Primary School under supervision, with periodic reports to be submitted by the Probation Officer.
