Stay Application / Ruling on Application for Stay of Proceedings Pending Appeal

  1. 1 Whether the applicant's intended appeal is arguable and not frivolous.
  2. 2 Whether exceptional circumstances exist to warrant stay of proceedings of the respondents' cross-petition pending appeal.
  3. 3 Whether the applicant would be unduly prejudiced if stay orders are declined and whether the intended appeal would be rendered nugatory.

Ratio Decidendi

The Court found that the applicant's intended appeal is arguable, particularly on whether the trial court properly exercised its discretion in denying adjournment and withdrawal of the petition, and whether dismissal rather than withdrawal prejudiced the applicant's rights. The Court held that special circumstances exist to warrant stay of proceedings, as further proceedings in the cross-petition could bar the applicant from litigating her claims due to res judicata. The Court concluded that the applicant would be prejudiced and the appeal rendered nugatory if stay was not granted. The application for stay of proceedings was therefore allowed pending determination of the intended appeal.
