The court declined to proceed to judgment because the applicants failed to provide a certified copy of the current land register, leaving the court uncertain as to the current registered proprietor of the suit land. Additionally, the service of summons on the 1st respondent was effected through an obscure classified notice, which the court found insufficient for substituted service. The Deputy Registrar's certification of the matter as ready for hearing was therefore erroneous. The court ordered the applicants to file a supplementary affidavit with the required land register documents and to effect fresh, prominent service of summons on both respondents before the matter could proceed....
