Procedural Posture

Employment and Labour Cause / Ruling on Applications for Review and Stay of Execution

  1. 1 Whether the applicants have established grounds for review of the judgment based on discovery of new and compelling evidence.
  2. 2 Whether the application for stay of execution pending review is merited.
  3. 3 Whether the withdrawal of the party and party bill of costs is properly before the court.

Ratio Decidendi

The court found that the applicants failed to demonstrate that the CCTV footage constituted new and compelling evidence that could not have been discovered with due diligence during the six years the suit was pending. The evidence was always within the applicants' knowledge, as it was stored in their servers in Bulgaria, and no attempt was made to retrieve it during the proceedings. The application for review was therefore an abuse of court process and a deliberate attempt to delay execution. The withdrawal of the party and party bill of costs was marked as withdrawn, but the application for review and stay of execution was dismissed with costs to the claimants.

Court Disposition

Applications for review and stay of execution dismissed with costs; party and party bill of costs marked as withdrawn.

Orders
