The court held that it retains jurisdiction to grant a stay of execution even after a Notice of Appeal has been filed to the Court of Appeal. However, for a stay to be granted under Order 42 Rule 6 of the Civil Procedure Rules, the applicant must satisfy three conjunctive conditions: demonstrate substantial loss if the stay is not granted, show that the application was made without unreasonable delay, and provide security for due performance of the decree. In this case, while the application was made promptly, the applicant failed to provide evidence of substantial loss or to concretely offer security in the form of a bank guarantee.
