Ratio Decidendi

The High Court held that the practice of trial magistrates transferring cases to higher courts without proper orders is illegal and must cease. The authority to transfer cases lies with the High Court or a Subordinate Court of the first class, and not with inferior courts. Since the trial magistrate had already forwarded the case to the High Court, the application for transfer was overtaken by events. Nevertheless, the High Court exercised its authority and formally transferred Kilungu Criminal Case No. 480 of 2005 to the Chief Magistrate’s Court at Machakos for hearing and final determination.
