Legal Issues
- 1 Whether the claimant is entitled to a refund of his contributions from the respondent Sacco.
- 2 Whether the respondent unlawfully withheld the claimant's contributions.
Ratio Decidendi
The Tribunal found that the claimant had established his membership in the respondent Sacco and the amount of Kshs. 82,962.97 as his contributions. The respondent failed to provide any evidence to dispute the claimant's membership or the amount claimed, nor did it respond to the withdrawal request. The Tribunal held that the claimant was entitled to a refund of his contributions, with costs and interest, as the respondent's mere denials without evidence could not defeat the claim. Prayers for share capital and damages were denied due to lack of sufficient basis or evidence.
Court Disposition
judgment for the claimant
Orders
- The respondent shall refund the claimant Kshs. 82,962.97.
- The respondent shall pay interest at court rates on Kshs. 82,962.97 from the date of filing until payment in full.
