Ratio Decidendi

The Court of Appeal held that the High Court erred in depriving the successful appellant of costs without providing a good reason as required by section 27 of the Civil Procedure Act. The mere lack of assistance from advocates did not constitute a sufficient basis to depart from the general rule that costs follow the event. The costs are payable to the party, not the advocate, and unless there is a compelling justification, a successful party should not be deprived of costs. The appellate court found that the High Court failed to exercise its discretion judicially and substituted the order, awarding costs of the appeal at the High Court and the Court of Appeal to the appellant.
