The Claimant's absence from work between 14th and 31st August 2017 was without permission or lawful reason, justifying termination on grounds of absenteeism. However, both Respondents failed to comply with the mandatory procedural requirements under section 41 of the Employment Act, as no disciplinary hearing was held and the Claimant was not given an opportunity to be heard. The 2nd Respondent's claim of mutual agreement to terminate was not supported by evidence. Consequently, the terminations were declared unlawful.
