Procedural Posture

Civil Appeal / Ruling on Preliminary Objection

  1. 1 Whether the appeal was filed within the statutory period prescribed by Section 79G of the Civil Procedure Act.
  2. 2 Whether the computation of time excludes Sundays or days when court offices are closed.

Ratio Decidendi

The court found that while Section 79G of the Civil Procedure Act prescribes a 30-day period for filing appeals from subordinate courts, the computation of time is governed by Section 57 of the Interpretation and General Provisions Act and Order 50 Rule 3 of the Civil Procedure Rules. These provisions stipulate that if the last day for filing falls on a Sunday or a day when court offices are closed, the act may be done on the next open day. In this case, the 30th day fell on Sunday, 8th April 2018, and the memorandum of appeal was filed on Monday, 9th April 2018, the next working day. Therefore, the appeal was filed within time, and the preliminary objection was without merit.
