The court found that although the trial magistrate failed to frame issues for determination, this irregularity could be cured on appeal. The respondents' claim was not statute barred because it was based on fraud, and limitation time runs from discovery of fraud. However, the sale agreements for the suit land entered into before confirmation of grant of letters of administration were invalid, as they constituted intermeddling with the estate of the deceased contrary to Sections 45 and 82 of the Law of Succession Act.
