Ratio Decidendi

The court found that while the application for stay was filed without unreasonable delay, the applicant failed to provide evidence of his inability to raise the decretal sum or to offer alternative security as required by the rules. Nonetheless, considering the lower court had already granted a stay on condition of security, the High Court exercised its discretion to relax the terms of security, ordering that half the decretal sum be deposited within 21 days as a condition for stay. Failure to comply would result in automatic dismissal of the application. Costs were awarded to the respondent.
