Miscellaneous Criminal Application / Ruling on Application for Review of Bail Denial

  1. 1 Whether the applicant should be granted bail pending trial after denial by the trial court.
  2. 2 Whether the trial court erred in finding the applicant a flight risk without sufficient evidence.
  3. 3 Whether the absence of a pre-bail report affected the fairness of the bail determination.

Ratio Decidendi

The High Court found that the trial court erred in denying bail to the applicant based solely on her arrest in a border town and possession of an Ethiopian identity card, without sufficient evidence of intent to abscond or lack of a fixed abode. The trial court failed to call for a pre-bail report, which would have provided necessary information about the applicant's social background and ties to the community. The mere circumstances of arrest did not amount to compelling reasons to deny bail. The state did not discharge its burden of proof to show compelling reasons as required by law. Therefore, the denial of bail was improper, and the applicant was entitled to reasonable bail terms.

Court Disposition
