Ratio Decidendi

The court found that the application to convert the certificate of taxation into judgment was unopposed, there was no reference challenging the certificate, and there was no dispute as to retainer. Accordingly, the court adopted the certificate of taxation as judgment for the advocate/client costs in the sum of Kshs.160,400, with interest at court rates from the date of taxation until payment in full. The court further ordered that a decree issue for the taxed costs, each party to bear their own costs of the application, and the applicant to serve the ruling and decree upon the respondent with a 14-day period for settlement, failing which execution would issue.
