The court found that the applicant could not acquire title by adverse possession because the suit property was registered in the name of Settlement Fund Trustees (SFT), a statutory corporation, from 1975 until 2019. Section 41 of the Limitation of Actions Act precludes adverse possession claims against government or statutory corporation land. Thus, time for adverse possession could not run in the applicant's favour until after SFT ceased to be proprietor. By the time the applicant filed suit in 2018, SFT was still the registered owner, and no statutory period had accrued.
