Ratio Decidendi

The court found that the trial court erred in applying the multiplier approach to assess damages for loss of dependency in respect of a deceased minor aged 8 years. Given the uncertainties and imponderables regarding the minor's future prospects, the global sum approach was more appropriate. The court held that the award of Kshs. 1,200,000.00 for loss of dependency was inordinately high and substituted it with a global sum of Kshs. 800,000.00. The rest of the awards for pain and suffering, loss of expectation of life, and special damages were left undisturbed. Each party was ordered to bear their own costs.

Court Disposition

Appeal partially allowed.
