The High Court found that the trial court properly exercised its discretion in apportioning liability and awarding damages. The appellant's vehicle was overtaking dangerously at a corner, which constituted negligence and justified the 80% liability finding. The evidence did not support shifting liability to the 2nd and 3rd respondents, but as they did not appeal, the apportionment stood. The award of Kshs. 120,000 for soft tissue injuries was within the reasonable range for such injuries and not inordinately high or low. The appellate court found no basis to interfere with the trial court's findings on either liability or quantum, and dismissed the appeal in its entirety.
