Legal Issues
- 1 Whether the applicant is entitled to early release based on favourable prison and probation reports.
- 2 Whether the period already served by the applicant justifies early release given the seriousness of the offence.
Ratio Decidendi
Despite favourable reports from the prisons and probation officer regarding the applicant's conduct, the court found that the period served—2 years and 10 months—was insufficient in light of the seriousness of the offence. The court held that early release could not be justified solely on the basis of good conduct where the sentence imposed reflected the gravity of the crime. The application for early release was therefore declined, and the applicant was ordered to serve the sentence to completion.
Court Disposition
Application for early release declined; applicant to serve sentence to completion.
Orders
- The application for early release is declined.
- The inmate to serve the sentence to completion.

Ruling
1. I have gone through the reports from prisons and probation officer with respect to the conduct of the inmate (convict)
2. Although the reports are both favourable I note that the inmate has only served 2 years 10 months of the sentence.
3. This cannot be termed as a long sentence in view of the seriousness of the offence he was convicted off.
4. I therefore decline to order for his early release.
5. The inmate to serve the sentence to completion.
Ruling delivered this 20th day of September, 2024. ________________D. KAVEDZAJUDGE
