The High Court found that the review and reconstitution of the party list for special seats in the County Assembly of Kakamega was within the exclusive prerogative of the Orange Democratic Movement, provided that no one had yet been declared elected. The declaration of election for special seats is by publication in the gazette, and once gazetted, the list is immune from amendment during the life of the Assembly unless by court order. The trial court erred by nullifying the appellant's election without sufficient proof from the 1st respondent that he was unfairly excluded or that the gazetted list was unlawful.
