Ratio Decidendi

The Tribunal found that the Claimants failed to provide evidence of the Sacco by-laws allegedly breached by the 1st Respondent. The evidence presented showed that the 1st Respondent followed proper loan appraisal procedures. The Claimants, by agreeing to be guarantors, entered into a contractual obligation to repay the loans in the event of default by the principal debtor. The 1st Respondent had exhausted all avenues of recovery, including selling the secured property, before seeking repayment from the guarantors. Therefore, the Claimants are liable for the outstanding loan amounts as guarantors. The Tribunal exercised its discretion on costs, ordering each party to bear their own costs.
