Procedural Posture

Civil Suit / Ruling on Notice of Motion for Stay of Execution and Constitutional Declarations

  1. 1 Whether the applicant has locus standi to prosecute the suit and application.
  2. 2 Whether the notice to show cause for execution infringes the applicants' right to liberty under Article 29 of the Constitution.
  3. 3 Whether the decree holder must exhaust less restrictive means before seeking arrest and detention for execution of a decree.

Ratio Decidendi

The court found that Dennis Kimani Mungai lacked locus standi to prosecute the suit or the application, as his grant of letters of administration was limited to the estate of his mother, Jane Njeri Mungai, and not the estate of Robert Mungai Mbugua, who was the plaintiff. Since no administrator had been appointed for the estate of Robert Mungai Mbugua after Jane Njeri's death, any pleadings or applications filed by Dennis Kimani Mungai were void ab initio and of no legal consequence. The court therefore expunged all such documents from the record and declined to consider the substantive issues raised in the application, including the constitutional challenge to the notice to show cause....

Court Disposition

Application struck out for want of locus standi.
