Ratio Decidendi

The court found that the applicants, as nieces and nephew of the deceased, were included as beneficiaries in the application for confirmation of grant and had signed the consent to the mode of distribution, which resulted in the estate being distributed wholly to the 2nd Respondent. There was no evidence that the deceased held the property in trust for the applicants or that the 2nd Respondent was to share the proceeds of sale with them. The Certificate of Confirmation of Grant did not impose any trust or sharing obligation on the 2nd Respondent. Further, the applicants failed to demonstrate any of the statutory grounds for revocation of grant under Section 76 of the Law of Succession...
