The Claimant's uncontroverted evidence established that he was not given an opportunity to defend himself or respond to the allegations before being terminated. The Respondent did not produce the termination letter or call any witnesses, and the reasons for termination were not substantiated. As such, the termination was both substantively and procedurally unfair under the Employment Act, 2007. The Claimant was therefore entitled to compensation, but only for two months' salary, salary in lieu of notice, and salary...
