Procedural Posture

Employment and Labour Relations Appeal / Judgment

  1. 1 Whether the appellant's suit was statute barred under the Limitation of Actions Act.
  2. 2 Whether the dismissal of the appellant was unfair.
  3. 3 Whether the trial court had jurisdiction to entertain the suit filed out of time.

Ratio Decidendi

The court held that the appellant's cause of action arose in 2004 upon receipt of the dismissal letter. The applicable limitation period was six years under section 4(1) of the Limitation of Actions Act, as the Employment Act 2007 was not yet in force. The suit was filed after the lapse of this period, making it statute barred. The court found that the lower court had no jurisdiction to extend the limitation period or entertain the suit. Leave to file out of time did not preclude the respondents from raising limitation as a jurisdictional issue. The appeal was therefore dismissed for lack of merit, and the trial court's decision was upheld.
