Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the appellant established ownership of the attached goods sufficient to sustain an objection to execution.
  2. 2 Whether the attachment and sale of the appellant's livestock was lawful given his non-party status in the original suit.

Ratio Decidendi

The appellant failed to provide any evidence before the trial court to establish, on a balance of probabilities, that he owned the livestock and goods attached and sold in execution of the decree. The supporting affidavit did not demonstrate that the goods were taken from his home or that he had any legal or equitable interest in them. The law requires the objector to prove ownership or interest in the attached property, and mere assertions in submissions are insufficient. As the appellant did not discharge this burden, the trial court was correct in dismissing the objection. The appeal was therefore dismissed for lack of merit.
