Although illness can be a reasonable ground for extension, the applicant did not provide evidence of his indisposition in the application or supporting affidavit, and submissions cannot substitute for evidence. Furthermore, the applicant failed to explain the additional delay after his alleged recovery. The court held that the applicant did not meet the threshold for extension of time under Rule 4 of the Court of Appeal Rules, and therefore dismissed the application with costs to the 1st respondent.
