The Machakos judgment was delivered without participation of all interested parties, including those in the stayed suits, and did not address the earlier order of this court. Adopting the Machakos judgment would violate the right to a fair trial for those not heard in that suit. The court also noted procedural irregularities, including failure by the 3rd and 4th Defendants to serve the Plaintiffs with the application.
