Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the termination of the Claimant’s employment was lawful and fair.
  2. 2 Whether the Claimant is entitled to the remedies sought.

Ratio Decidendi

The court found that the Respondent failed to establish a valid reason for terminating the Claimant’s employment and did not follow the procedural fairness requirements under Section 41 of the Employment Act. There was no evidence that the Claimant’s alleged poor performance was raised with her or that she was given an opportunity to improve. Additionally, the error cited as the basis for termination was rectified without loss to the Respondent. The discharge and clearance certificate signed by the Claimant did not absolve the Respondent of its statutory obligations. Consequently, the termination was both substantively and procedurally unfair, entitling the Claimant to compensation.

Court Disposition

Judgment for the Claimant for four months’ salary in compensation, with interest and costs.

Orders

  • The Respondent shall pay the Claimant Kshs. 782,244 being four months’ salary in compensation.
