Ratio Decidendi

The court found that the Land Disputes Tribunal had no jurisdiction to determine disputes relating to shares in a co-operative society, as such matters are not among those specified under Section 3(1) of the Land Disputes Tribunals Act. The dispute in question concerned shares in Katheka Kai Co-operative Society, which, even if related to land, must be resolved under the Co-operative Societies Act. Since the Tribunal acted outside its statutory mandate, its award and the subsequent adoption as a judgment by the Chief Magistrate's Court were unlawful. The court therefore granted an order of certiorari to quash the Tribunal's award and ordered the interested party to pay costs.
