Ratio Decidendi

The court found that the application for dismissal was incompetent because it was filed less than one year after the last step in the proceedings, which was the hearing date for the application to amend the plaint on 22nd July, 2011. Since the application for amendment was still pending, the plaintiff could not be expected to set the suit down for hearing. The defendant's application for dismissal was therefore premature and did not satisfy the requirements of Order 17 rule 2(1) of the Civil Procedure Rules. The court dismissed the application with costs to the plaintiff.
