The court found that the Respondent lodged the appeal with the Eastern Provincial Land Appeals Committee on 11th July, 2008, while the Tribunal.s award was made on 9th April, 2008. Section 8(1) of the Land Disputes Tribunals Act (repealed) requires appeals to be filed within thirty days of the Tribunal.s decision. The Respondent.s argument that time started running from the date the Magistrate adopted the award (18th June, 2008) was rejected. The statutory period commenced from the date of the Tribunal.s award, not the adoption date. As a result, the appeal to the Appeals Committee was filed out of time and was therefore incompetent.
