The High Court found that while the prosecution proved the elements of defilement—age, penetration, and identity of the accused—beyond reasonable doubt, the circumstances of the case triggered the statutory defence under section 8(5) of the Sexual Offences Act. The complainant, though under 18 by a few months, behaved as an adult, her parents were involved in the relationship, and there was no evidence the appellant knew her exact age. The court held that the appellant was misled by the conduct of the complainant and her parents, and thus the statutory defence applied. The conviction was quashed and the sentence set aside, as the appellant was entitled to acquittal on this ground.
