The High Court held that the Provincial Land Disputes Appeals Committee lacked jurisdiction to overturn or vary a judgment and decree already adopted by a court of competent jurisdiction. The Mathira Land Disputes Tribunal's award, together with the Land Registrar's report, had been adopted as a judgment by the Senior Resident Magistrate's Court, Karatina, and was not the subject of review or appeal. The subsequent decision by the Appeals Committee purporting to set aside or alter that judgment was therefore a nullity. To avoid conflicting judgments and judicial chaos, the High Court struck out the appeal as having been overtaken by events, since the original court decree remained valid...
