The court found that the applicant failed to provide a satisfactory explanation for the delay in filing the appeal, as no reason was advanced in the affidavits and the purported explanation regarding Covid-19 was only raised in submissions, which cannot substitute for evidence. Despite this, the court considered that the draft memorandum of appeal raised an arguable issue regarding future medical expenses and that any prejudice to the respondent could be compensated by costs.
