As such, the objection on limitation could not be determined at the preliminary stage. On the issue of land board consent, the court followed recent Court of Appeal authority holding that failure to obtain consent within six months does not render the transaction void, and that equity and fairness should guide the interpretation of the Land Control Act. Consequently, both grounds of the preliminary objection failed, and the objection was dismissed.
