The Tribunal found that the claimant had properly resigned from the respondent Sacco by submitting a resignation letter dated 28th June 2022, which was acknowledged. While the claimant sought a refund of his deposits, the respondent argued that outstanding loans must first be cleared. The Tribunal held that, under Section 34 of the Cooperative Societies Act, the Sacco has a first charge over a member's deposits to offset any outstanding debts. The respondent's by-law provision prohibiting resignation with outstanding loans is void to the extent it contradicts the Act, provided the member's deposits exceed the debt.
