The court found that its earlier order of 1st February 2023, which dismissed the applicant's reference for being filed out of time, was made in error because it failed to consider an existing order of 23rd June 2021 that had already granted the applicant leave to file the reference out of time. This omission constituted an error apparent on the face of the record. The court held that had it been aware of the earlier order, it would not have dismissed the application. Consequently, the threshold for review under Section 80 of the Civil Procedure Act and Order 45 Rule 1 of the Civil Procedure Rules was met.
