The instructions to act were issued by Jamii Bora Bank, not the Respondent, and the Letter of Offer between the bank and the Respondent only allowed the bank to recover legal fees from the borrower's account, not for the Advocate to recover directly from the borrower. Paragraph 31 of the Advocates Remuneration Order does not create privity of contract between the Advocate and the borrower.
