Ratio Decidendi

The court found that the Applicant had obtained a certificate of taxation for the sum of Kshs.2,131,704/-, which had not been set aside or varied. The Respondent did not oppose the application or dispute the retainer. Section 51(2) of the Advocates Act and relevant case law establish that in such circumstances, the court is obligated to enter judgment for the certified sum. The court also found that the Applicant was entitled to interest at 14% per annum from 28th October, 2021, being one month after service of the bill of costs, until payment in full. The costs of the application were also awarded to the Applicant, as the application was unopposed and the Applicant was successful.
