Ratio Decidendi

The court found that there was no dispute as to the retainer and no issues requiring trial, thus judgment could be entered for the sum in the certificate of costs. The court held that interest under Rule 7 of the Advocates Remuneration Order is chargeable from one month after delivery of the bill of costs, provided the bill remains unpaid after that period. In this case, the bill was delivered on 8th April, 2013, and not paid within a month, entitling the applicant to interest at 14% per annum from 8th May, 2013 until payment. The court further held that the applicant, as an advocate acting for himself, is entitled to necessary costs of the application to enforce the certificate of costs....
