The court found that the appellants failed to satisfy the requirements for grant of stay of execution pending appeal as set out in Order 42 Rule 6 of the Civil Procedure Rules. Specifically, the appellants did not demonstrate that substantial loss would result if stay was not granted, nor did they offer any security for the due performance of the decree. The application was brought promptly, but the absence of a copy of the ruling and lack of evidence of substantial loss or security were fatal to the application. The court therefore declined to grant the orders sought, with costs to abide the outcome of the appeal.
