Miscellaneous Criminal Application / Ruling on Interlocutory Application for Revision and Stay

  1. 1 Whether the High Court should call for and examine the Magistrate's Court record in Kerugoya MCTR/217/2019 to determine the regularity of the proceedings.
  2. 2 Whether an order of mistrial should be issued in respect of the charges and proceedings against the applicant.
  3. 3 Whether the accused's trial should be stayed pending determination of the application for revision.

Ratio Decidendi

The High Court found that a prima facie case for revision had been established on the basis that the trial court's acceptance of a guilty plea must be scrutinized for regularity, especially where the record may reveal sufficient cause not to accept the plea. The Court held that it is necessary to call for and examine the trial court file to determine the legality of the proceedings before making a substantive ruling on the application for review. Pending this examination, the Court exercised its supervisory jurisdiction and revisionary powers to stay the accused's trial until the application is determined.

Court Disposition

Application for calling and examining trial court record granted; stay of trial ordered pending determination of application.

Orders
