The appellate court found that the appellant was solely liable for the accident that caused the deceased's death, as the evidence from the eye witness (PW3) was more persuasive and established that the appellant entered the highway at high speed without ensuring the road was clear, amounting to negligence. The appellant failed to discharge the burden of proving negligence on the part of the 3rd respondent. The trial court erred in apportioning liability at 50:50; the appellant should be held 100% liable.
